Terms of Service
Effective from: August 21, 2026
These Terms of Service ("Terms") apply to all services ("Services") provided by Core Markets LLC, trading as Core Funded ("Core Funded", "we", "us", or "Provider"), primarily via the website www.corefunded.io (the "Website").
Please read these Terms carefully. They contain a binding arbitration provision and class action waiver in Section 15 that affect how disputes between you and us are resolved. You may not use our Services if you do not fully understand or accept these Terms, or any part of them.
1. BASIC PROVISIONS
1.1. Contracting parties and scope
1.1.1. These Terms govern the contractual relationship between Core Markets LLC and you ("Customer" or "you") regarding the use of all Services offered by Core Funded.
1.1.2. The Services include, in particular, evaluations (Two-Step Challenge, One-Step Challenge, Instant Funding), analysis services, simulated trading accounts ("Demo Accounts"), and additional services ("Add-Ons").
1.1.3. The language of the contract is English. Where we provide translated versions of these Terms, the English version prevails in the event of any inconsistency.
1.1.4. Core Markets LLC is a limited liability company organized under the laws of the State of Delaware, United States, with its registered address at 8 The Green, Ste B, Dover, DE 19901.
1.2. Conclusion of contract
1.2.1. The contract between Core Funded and the Customer is concluded as soon as the Customer registers on the Website or orders a Service and Core Funded confirms that order or registration, for example by email.
1.2.2. These Terms become part of the contract upon confirmation or upon use of the Services.
1.3. Eligibility
1.3.1. Our Services are available only to natural persons who are at least 18 years of age and have the legal capacity to enter into a binding contract.
1.3.2. You may use the Services only in jurisdictions where such use is legally permitted. You are responsible for determining whether your use of the Services complies with the laws applicable to you.
1.3.3. You may not use the Services on behalf of any other person, or permit any other person to use your account.
1.4. Restricted jurisdictions and sanctions
1.4.1. We do not accept customers who are residents of, or located in, Afghanistan, Belarus, Burundi, the Central African Republic, the Republic of the Congo, Cuba, Crimea, the Democratic Republic of the Congo, Eritrea, Guinea, Guinea-Bissau, Iran, Iraq, Liberia, Libya, Myanmar, North Korea, Papua New Guinea, Russia, Somalia, South Sudan, Sudan, Syria, Vanuatu, Venezuela, Yemen, or Zimbabwe ("Restricted Jurisdictions").
1.4.2. You represent and warrant that you are not: (a) located in, under the control of, or a national or resident of any Restricted Jurisdiction; (b) listed on any U.S. Government list of prohibited or restricted parties, including the Specially Designated Nationals and Blocked Persons List maintained by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC); or (c) otherwise subject to applicable sanctions.
1.4.3. If you violate these requirements, or if we determine that you are subject to sanctions, we may suspend or terminate your account immediately and without refund.
1.5. No offer of financial services
1.5.1. Core Funded is not a broker, dealer, futures commission merchant, commodity trading advisor, commodity pool operator, investment adviser, exchange, bank, or financial services provider, and is not registered with or regulated by the U.S. Securities and Exchange Commission, the Commodity Futures Trading Commission, the National Futures Association, FINRA, or any comparable authority in any jurisdiction.
1.5.2. Core Funded does not accept client deposits, does not hold client funds, and does not execute orders in live markets on your behalf.
1.5.3. All accounts displaying virtual balances are provided for educational, training, and evaluation purposes only, in a simulated environment.
1.6. No investment advice
1.6.1. We do not provide individualized investment recommendations, financial advice, tax advice, legal advice, or risk advice for real trading decisions. All activity you carry out in the simulated environment is at your own risk and does not constitute a recommendation to replicate that activity in real markets.
1.7. Identity verification (KYC/AML)
1.7.1. As part of our Know Your Customer procedures, we may require identity documents, proof of residence, and other documentation in order to verify your identity, satisfy our anti-money laundering and counter-terrorism financing obligations, and prevent fraud.
1.7.2. Identity verification may be performed on our behalf by a third-party verification provider.
1.7.3. If requested documentation is not provided, we may suspend your account, withhold payouts, or terminate the contractual relationship.
1.8. Risk notice
1.8.1. You acknowledge that trading financial instruments, including foreign exchange, contracts for difference, commodities, indices, and digital assets, involves substantial risk, including the possibility of total loss.
1.8.2. Results achieved in a simulated environment cannot be transferred one-to-one to live trading accounts.
1.8.3. CFTC Rule 4.41. Hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, because the trades have not been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, including lack of liquidity. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.
1.8.4. Nothing in these Terms shall be interpreted as meaning that Core Funded conducts any regulated activity or requires any regulatory license or approval.
2. SCOPE OF SERVICES
2.1. Simulated trading accounts and evaluation programs
2.1.1. Core Funded provides Demo Accounts in which users trade in a simulated environment in order to test strategies and meet defined evaluation criteria, such as profit targets and drawdown limits.
2.1.2. Successful completion of a Two-Step Challenge, One-Step Challenge, or Instant Funding program gives the user the opportunity to access a simulated funded account.
2.2. Scope
2.2.1. The applicable requirements — profit targets, drawdown limits, daily risk limits, and similar parameters — are published on our Website before the contract is concluded.
2.2.2. Core Funded may change, replace, or supplement content, tools, software, market analyses, or prices at any time. Changes to the rules applicable to an account you have already purchased are governed by Section 13.
2.3. Challenge types
2.3.1. Core Funded offers three models:
- Instant Funding — immediate access to synthetic capital with no profit target
- One-Step Challenge — one phase with a 10% profit target
- Two-Step Challenge — two phases with 10% and 5% profit targets
2.3.2. Available capital ranges from $5,000 to $200,000, scalable up to $3,200,000.
3. ORDERS, FEES AND PAYMENT
3.1. Ordering process
3.1.1. Orders are placed online via our Website. The Customer selects the desired Service and any optional Add-Ons.
3.1.2. A contract is concluded once Core Funded confirms receipt of payment.
3.2. Fees
3.2.1. All fees are listed on the Website. Stated amounts include applicable taxes unless otherwise specified.
3.2.2. The fee depends on, among other things, account size, model selected, and any Add-Ons.
3.3. Payment methods
3.3.1. We accept credit and debit cards, bank transfers, and, where available, digital assets.
3.3.2. The Customer bears any transaction, conversion, or transfer fees charged by their bank or payment provider.
3.4. Due date and default
3.4.1. Unless otherwise agreed, fees are due immediately.
3.4.2. If payment is not completed, Core Funded may cancel the order or withhold access to the Services.
3.5. Chargebacks
3.5.1. Filing a chargeback or payment dispute without first contacting our support team may result in immediate suspension of your account and forfeiture of any associated balances.
3.5.2. If you believe a charge is incorrect, contact support@corefunded.io before contacting your bank or card issuer. We will investigate and respond.
3.6. Discounts and promotions
3.6.1. Discounts and promotional codes may not be combined with other concessions unless expressly confirmed by us in writing.
3.6.2. Promotional terms, including eligibility conditions, are stated at the time the promotion is offered. Where a promotion is restricted to specific customers, we will decline ineligible orders at checkout rather than charge and subsequently void them.
3.7. Payment processing
The provider of the Services is Core Markets LLC. Payment processing is carried out by Odeonpay ALE S.R.L. ("Paysagi"), which acts solely as Merchant of Record for payment processing purposes. Paysagi is not the provider of the goods or services. Payment processing is subject to Paysagi's terms of use, available at https://paysagi.com/terms-of-use/, which are displayed to the Customer during the payment process.
4. CUSTOMER ACCOUNTS
4.1. Registration
4.1.1. Unless otherwise agreed in writing, each Customer may maintain only one customer account ("Client Section").
4.1.2. The Customer must provide truthful, accurate, and current information on registration and keep it up to date.
4.2. Login credentials and security
4.2.1. The Customer must keep login credentials confidential and is responsible for all activity carried out under their account.
4.2.2. Core Funded must be notified immediately at support@corefunded.io in the event of suspected unauthorized access or misuse.
4.3. Availability
4.3.1. Core Funded aims to maintain high availability. Technical faults, scheduled maintenance, third-party outages, or force majeure may cause temporary interruptions.
4.3.2. There is no entitlement to constant, uninterrupted availability of the Services.
4.4. Multiple accounts and shared IP addresses
4.4.1. Where several persons access Core Funded from the same household or IP address, we may request additional verification to confirm that they are distinct customers.
4.4.2. Circumventing account limits or program rules through the use of multiple accounts may result in closure of the accounts concerned.
4.5. Confidentiality
4.5.1. The Customer must treat non-public information or materials obtained through the Services — including internal analyses and proprietary data — as confidential, and may not disclose them to third parties without our prior written consent.
4.5.2. This clause does not restrict your right to publish reviews, feedback, or public statements about your experience with our Services.
5. SIMULATED TRADING AND PROHIBITED PRACTICES
5.1. Nature of simulated trading
5.1.1. During simulated trading on the platform, you may execute any transaction that does not violate these Terms or the prohibited practices in Section 5.3.
5.1.2. All balances shown in evaluation and Instant Funding programs are virtual. There is no real exchange of money; all profits and losses form part of a simulated scenario.
5.1.3. You remain obliged to comply with generally accepted market standards and risk management practices. Additional restrictions may arise from the terms of the trading platform you use.
5.1.4. You may pause or end your simulated trading at any time. Core Funded makes no representation that simulated performance can be replicated in live trading environments.
5.2. Access to and use of trading data
5.2.1. Core Funded may review all simulated trading data, including transaction history, open positions, and profit and loss.
5.2.2. You consent to Core Funded sharing such data with its affiliated entities and with service providers engaged to detect fraud or rule violations.
5.2.3. Simulated trading does not constitute investment advice or a recommendation by you to Core Funded, or by Core Funded to you.
5.2.4. Core Funded accepts no responsibility for the accuracy, timeliness, or completeness of price, market, or statistical data displayed within the platform or customer area, subject to Section 10.
5.3. Prohibited trading practices
The following are prohibited on the Core Funded platform.
Strategy consistency. You must use a materially consistent strategy across the Challenge and funded phases. Using one strategy to pass a Challenge and a materially different one after funding — for example, an Expert Advisor during the Challenge followed by discretionary manual trading — is not permitted.
System exploitation and market manipulation. The following are strictly prohibited:
- Exploiting pricing errors, platform errors, or technical faults
- Latency arbitrage, including exploiting delays in price transmission
- Trading on the basis of material non-public information
- Front-running pending orders or internal information
Practices affecting our broker or liquidity relationships. Trading activity that could jeopardize our relationship with our broker or liquidity provider, cause trades to be cancelled, or create regulatory problems for the broker is prohibited.
High-risk and gambling-style practices. The following are prohibited:
- All-or-nothing trading — executing trades in which a single position could cause total loss of the account
- Gambling-style trading — more than 50% of trades held for less than one minute, or trading without any recognizable strategy or market analysis
- Aggressive position scaling — excessive adding to profitable trades, or averaging into losing trades beyond reasonable risk limits
- Multiple positions in losing trades — opening three or more positions in a single losing trading idea
- Excessive margin use — using more than 50% of available margin
- Unhedged position scaling — adding multiple positions without protective measures on prior trades
Abuse of the trading environment. This includes consistently executing high-volume trades without a recognizable strategy, disregarding basic risk management, and providing implausible or falsified trading data.
Our risk management team may grant exceptions following individual review of a trader's activity.
5.4. Reserved rights of Core Funded
5.4.1. Immediate action on suspicion. Where we suspect a rule violation, or unfair or unlawful conduct, Core Funded may take the following measures immediately and without prior notice:
- Immediate closure of accounts
- Denial or suspension of payouts
- Blocking access to all Services
- Termination of the business relationship
5.4.2. No obligation to provide reasons. For security reasons and to protect the integrity of our platform, we are not obliged to disclose to the Customer the specific reasons for our measures or which specific rules were deemed violated.
5.4.3. Finality of the decision. Core Funded's decision regarding suspected violations is final. There is no entitlement to restoration of the account or release of withheld payouts where a violation is suspected on reasonable grounds.
5.5. Consequences of violations
5.5.1. Where a prohibited practice is identified on your account:
- Participation in the affected program may be terminated
- Fees paid for the affected account are forfeited
- Simulated profits derived from the violating activity are forfeited
- The account may be suspended or closed and rendered ineligible for future payouts
5.5.2. All trading activity is reviewed before a funded account is issued and before payouts are processed.
5.5.3. Where an account is closed following a confirmed violation, the Customer may purchase a new account, in some cases at a discounted price.
5.6. Risk restrictions
5.6.1. Core Funded may impose specific risk restrictions on an account where necessary to maintain responsible trading practices — for example, limiting risk per trading idea to a maximum of 1% of the original account balance.
5.6.2. Any such restriction will be communicated to you in writing, with the reason for it, before it takes effect.
5.6.3. Failure to comply with a communicated risk restriction may result in account suspension. Accounts suspended on this basis are not eligible for payouts.
5.6.4. Risk restrictions may be reviewed and lifted where consistent compliance is demonstrated over time.
5.7. External trading activity
5.7.1. Core Funded assumes no responsibility for your live trading or other investment activity outside the simulated environment, even where you apply information or strategies derived from our platform.
5.7.2. Financial markets are subject to significant fluctuation. Past performance, and in particular simulated performance, does not guarantee future results.
6. CHALLENGE PROGRAMS AND TRADING RULES
6.1. Trading period
There is no time limit for reaching profit targets. You may trade for as long as you wish, subject to the inactivity rule in Section 6.7.

Instant Funding. No profit target. You may begin trading and generating simulated profit immediately.
1-Step Challenge. A profit target of 10% of the starting capital is required.
Example ($100,000 account): starting capital $100,000; profit target $10,000; target balance $110,000. On success, the account converts to a funded account with no further profit target.
2-Step Challenge. Two consecutive profit targets are required.
Phase 1: 10% profit on the original account balance, observing all trading rules. On success, you proceed to Phase 2.
Phase 2: 5% profit on the original account balance. The balance is reset to the original account size at the start of the phase. On success, you gain access to the funded account.
Example ($100,000 account): Phase 1 target $10,000, success at $110,000 or above. Phase 2 starts at $100,000 (reset), target $5,000, success at $105,000 or above.
Calculation. The profit target is always calculated from the original account balance:
Profit target = Original account balance × profit percentage
What counts as profit. Realized profits from closed positions count. Unrealized profits from open positions do not. Swap fees and commissions are deducted.

Calculation. At 00:00 UTC we take the higher of account balance or account equity and subtract the fixed percentage of the original account balance from it.
Instant Funding and 1-Step, example 1 ($100,000 account): with an open trade showing $2,000 profit, account equity is $102,000. Equity may not fall below $99,000 ($102,000 − $3,000).
Instant Funding and 1-Step, example 2 ($100,000 account): with an open trade showing a $2,000 loss, equity is $98,000. As the balance ($100,000) is higher, it is used as the basis. Equity may not fall below $97,000.
2-Step, example ($100,000 account): maximum daily loss $5,000. With equity at $103,000, equity may not fall below $98,000.
Notes. The daily loss limit resets at 00:00 UTC. Account equity means balance plus open positions. Unrealized losses are included. If the limit is breached, the account is stopped immediately.

The drawdown is static in every model: the level is set at the start and does not follow profits upward. It includes all losses, fees, and open positions.
Instant Funding ($100,000 account): the drawdown level stays fixed at $95,000, regardless of profit.
1-Step Challenge ($100,000 account): the drawdown level stays fixed at $94,000, regardless of profit.
2-Step Challenge ($100,000 account): the drawdown level stays fixed at $92,000, regardless of profit.
Notes. Unrealized losses from open positions are included. If the limit is breached, the account is stopped immediately. The level stays the same from start to finish.
6.5. Leverage
Standard leverage is 1:100. For digital assets, reduced leverage of 1:5 applies.
6.6. Profit split
Core Funded offers a profit split of 80–95%. You receive up to 95% of simulated net profit as a real payout. The exact rate depends on your account model, performance, and scaling level.
6.7. Inactivity
If no trade is executed within 30 days, the account is closed automatically. This applies to both Challenge and funded accounts.
6.8. News trading
During a Challenge. News trading is fully permitted.
On a funded account. You may not open or close trades within 5 minutes before and 5 minutes after high-impact news events (red-folder events in the economic calendar) and FOMC speeches, statements, and releases.
News Trading upgrade (optional). You may add the News Trading upgrade when purchasing your challenge or instant account. It removes the blackout window entirely, for all instruments including FOMC events, and applies to the whole account including the funded phase. It is selected once, at the time of purchase.
Without the upgrade, trades executed during a blackout window do not result in account suspension, but profits derived from those trades are removed.
All times referenced in this Section are UTC. Your dashboard displays trade times in your local time zone for reference; the UTC timestamp governs.
6.9. Hedging, martingale and stop losses
Hedging within the same account is permitted. Martingale strategies are not permitted. Stop losses are not mandatory.
6.10. Minimum trading days

You must achieve at least 0.5% net profit on the required number of days. Days need not be consecutive. Only realized profits from closed trades count. A trading day runs from 00:00 to 23:59 UTC.
On a funded account, the count restarts after successful completion of the Challenge.
6.11. Overnight and weekend positions
Overnight positions are permitted. Weekend positions are permitted. Digital asset markets are available 24/7, including weekends.
6.12. EAs, trade copiers and copy trading
Expert Advisors, trade copier software, and copy trading are all permitted, including:
- Copy trading between Core Funded accounts
- Copy trading between funded and Challenge accounts in either direction
- Copy trading between Core Funded accounts and external accounts
Condition. Copy trading is permitted only between accounts legally held by the same account holder. Copying between accounts held by different persons, and participation in coordinated group trading, is not permitted.
All Challenge rules — daily loss, drawdown, and consistency — apply separately to each account.
6.13. Consistency rule
The consistency rule ensures that no single profitable day accounts for an excessive share of total profit.

Instant, example: with total profit of $2,000, a maximum of $300 may derive from any single day.
1-Step and 2-Step, example: with total profit of $5,000, a maximum of $1,500 may derive from any single day.
Notes. The rule is assessed at the payout stage. It applies to net profit for the day. Traders may continue trading until the ratio is satisfied. Where the rule is not met, the payout amount may be restricted; the account is not closed and profits are not forfeited on this basis alone.
7. SIMULATED FUNDED ACCOUNTS
7.1. Nature of funding
7.1.1. The simulated funded account holds no real funds, notwithstanding the use of live market data.
7.1.2. Payouts represent performance-based compensation calculated by reference to simulated results. They are not profits from live trading and are not returns on an investment.
7.2. Profit share
7.2.1. By default the Customer receives 80% of simulated net profits. With applicable Add-Ons this may increase to 95%.
7.2.2. Each payout may include a maximum of 50% of total simulated profit. The maximum payout per request is $2,500 for accounts up to $100,000, and $5,000 for accounts above $100,000. Remaining profit carries forward to the next payout period.
7.3. Inactivity and termination
7.3.1. If a funded account remains inactive for 30 days it may be closed.
7.3.2. Where a violation of the risk rules or prohibited practices is identified, the profit share entitlement lapses and Core Funded may close the account immediately.
8. PAYOUTS
8.1. Payout schedule
The first payout may be requested 14 days after the first trade on a funded account. Subsequent payouts may be requested every 14 days.
8.2. Requirements
- Account balance must be above the original account balance
- No confirmed rule violations
- All positions must be closed, with no open trades or pending orders
- For each payout after the first, at least 3 qualifying trading days (each with ≥ 0.5% net profit) must have been achieved since the previous payout
8.3. Process
- You request the payout in your dashboard
- We review the profit and compliance with the rules
- Payment is issued by bank transfer or digital asset transfer
8.4. Payout guarantee
8.4.1. We guarantee processing of your payout within 24 hours. If we fail to process within that period, you receive 100% of your simulated profit for that payout rather than your standard split.
8.4.2. The 24-hour period begins once your account review is complete and all requested documentation has been submitted in full. Outstanding documentation pauses the period.
8.4.3. The guarantee applies to our processing time. It does not cover the time taken by your bank, payment provider, or blockchain network to make funds available to you.
8.5. Minimum amounts
Funded account payout: $25 minimum. Affiliate payout: $25 minimum.
8.6. Fee reimbursement
The Challenge fee is refunded in full on your fourth payout. If the account is lost before the fourth payout due to a confirmed serious rule violation, the fee is not refunded.
9. REFUNDS AND CANCELLATION
9.1. Nature of the product
The Services consist of digital content and access to a simulated trading environment, delivered immediately upon purchase. By completing your purchase you request immediate performance and acknowledge that performance begins at once.
9.2. No refunds
9.2.1. All purchases are final. Except as set out in Section 9.3 or as required by mandatory law applicable to you, there is no entitlement to a refund, including where an evaluation is not passed.
9.2.2. This applies equally to purchases made through affiliates, resellers, or white-label partners.
9.3. Exceptions
We will issue a refund where:
- Payment was taken but account credentials were never delivered and we are unable to deliver them
- A purchase was made by a customer ineligible for a promotion, where the order should have been declined at checkout
- A duplicate charge was applied in error
- Mandatory consumer protection law in your jurisdiction grants you a cancellation right that cannot be waived
9.4. Cancellation of your account
You may close your customer account at any time by writing to support@corefunded.io. Closure does not entitle you to a refund of fees already paid, except as set out in Section 9.3.
9.5. Payment disputes
Customers who file a chargeback or payment dispute without first contacting our support team may be permanently banned from the platform. Contact support@corefunded.io before contacting your bank or card issuer.
10. DISCLAIMERS AND LIMITATION OF LIABILITY
10.1. Disclaimer of warranties
10.1.1. To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
10.1.2. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that market data, prices, or statistics displayed will be accurate, complete, or current.
10.1.3. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
10.2. Limitation of liability
10.2.1. To the maximum extent permitted by applicable law, Core Funded, its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of simulated profits, business interruption, loss of data, or lost opportunity, arising out of or in connection with the Services, whether based in contract, tort, strict liability, or otherwise, and whether or not we have been advised of the possibility of such damages.
10.2.2. Liability cap. Our total aggregate liability arising out of or relating to these Terms or the Services shall not exceed the total amount of fees you paid to Core Funded in the twelve months preceding the event giving rise to the claim.
10.2.3. External trading. We accept no liability for losses incurred on live trading accounts or with third parties, even where you apply strategies or information derived from our simulated environment. All live trading decisions are entirely your responsibility.
10.2.4. No advisory relationship. The information, services, and simulated environments provided do not constitute investment, legal, or tax advice. We accept no liability for financial or legal consequences arising from your independent use of such information.
10.2.5. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.
10.3. Force majeure
10.3.1. Events beyond our reasonable control — including natural disasters, government action, war, civil unrest, strikes, pandemics, power or network failures, server outages, and cyberattacks — suspend our performance obligations for the duration of the disruption.
10.3.2. We are not responsible where disruptions, failures, or damages are caused by third parties, including payment providers, internet service providers, data centers, hosting providers, liquidity providers, or platform vendors, outside our direct control.
11. VIOLATIONS AND INDEMNIFICATION
11.1. Unlawful use
Where we become aware of unlawful content or conduct, we may remove the content and suspend or close the account concerned.
11.2. Sanctions for violations
11.2.1. Where the Customer violates these Terms, in particular the prohibited practices in Section 5.3, Core Funded may at its own discretion restrict or terminate the Services in whole or in part.
11.2.2. Simulated profits may be withheld and accounts closed.
11.3. Indemnification
You agree to indemnify, defend, and hold harmless Core Markets LLC, its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your breach of these Terms, your violation of applicable law, or your misuse of the Services.
12. DATA PROTECTION
12.1. Core Funded collects, processes, and uses personal data in accordance with our Privacy Policy, available at corefunded.io, which forms part of these Terms.
12.2. Personal data is processed in particular for the performance of the contract, compliance with legal obligations including KYC and AML requirements, fraud prevention, and our legitimate business interests.
12.3. We may share personal data with service providers engaged to perform hosting, payment processing, identity verification, communications, and analytics, and with authorities where required by law.
12.4. Full details of the categories of data collected, the purposes of processing, recipients, retention periods, and the rights available to you are set out in the Privacy Policy.
13. CHANGES TO THESE TERMS
13.1. Non-material changes
13.1.1. We may make non-material changes to these Terms — including corrections of typographical errors, clarifications, changes to contact details, and editorial or formatting adjustments — that do not adversely affect your rights or obligations.
13.1.2. Such changes take effect on publication on the Website or in the customer area.
13.2. Material changes
13.2.1. Where changes affect essential contractual elements or materially impair your rights and obligations — including changes to the Services, fees, liability provisions, or trading rules — we will notify you at least 14 days before they take effect, by email or in the customer area.
13.2.2. You may object to the change in writing within 14 days of the notice.
13.2.3. If you object within the deadline, we may terminate the contractual relationship. Fees paid for Services not yet delivered will be refunded on a pro rata basis, unless grounds for immediate exclusion exist.
13.2.4. If you do not object and continue to use the Services after the 14-day period, the amended Terms are deemed accepted.
13.3. Rules applying to existing accounts
13.3.1. Changes to trading rules, profit targets, drawdown limits, or payout conditions do not apply retroactively to accounts already purchased. Accounts purchased before a change continue under the rules in force at the time of purchase until that account ends, unless the change is to your benefit or you agree otherwise.
14. TERM, TERMINATION AND SUSPENSION
14.1. Term
The contractual relationship runs for an indefinite period unless a fixed-term offer is agreed.
14.2. Termination by the Customer
14.2.1. You may terminate the contractual relationship at any time on 7 days' notice, by email to support@corefunded.io or via the customer area.
14.2.2. Termination during an ongoing Service does not entitle you to a pro rata refund, except as set out in Section 9.3.
14.3. Termination by Core Funded
14.3.1. We may terminate without notice for good cause, including serious breach, abuse, fraud, sanctions exposure, or chargeback abuse.
14.3.2. We may otherwise terminate on 14 days' notice. Where we terminate on this basis and you hold an active account, we will refund fees paid for Services not yet delivered on a pro rata basis.
14.4. Suspension
14.4.1. Instead of terminating, we may temporarily suspend an account pending investigation.
14.4.2. You will be informed of the suspension and its basis. If the suspicion is not confirmed, the account will be reinstated and any withheld payout processed.
15. DISPUTE RESOLUTION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
15.1. Informal resolution first
Before commencing any formal proceeding, you agree to contact us at support@corefunded.io and describe the dispute, so that we may attempt to resolve it informally. Both parties agree to negotiate in good faith for 30 days from the date of that notice. This step is a precondition to arbitration.
15.2. Binding arbitration
15.2.1. If the dispute is not resolved within the 30-day period, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
15.2.2. The arbitration shall be conducted in the English language. The seat shall be Wilmington, Delaware. Arbitration may be conducted remotely by video or on the basis of written submissions where the amount in dispute permits.
15.2.3. The arbitrator has exclusive authority to resolve any dispute regarding the interpretation, applicability, or enforceability of this arbitration agreement.
15.2.4. Judgment on the award may be entered in any court of competent jurisdiction.
15.3. Class action waiver
YOU AND CORE FUNDED AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative proceeding.
15.4. Exceptions
Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights or prevent unauthorized access to the Services, without first following Sections 15.1 to 15.3.
15.5. Opt-out
You may opt out of the arbitration agreement and class action waiver in Sections 15.2 and 15.3 by sending written notice to support@corefunded.io with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
15.6. Time limit
Any claim arising out of or relating to these Terms or the Services must be brought within one year after the claim arose, or it is permanently barred, except where a longer period is required by mandatory law.
16. GENERAL PROVISIONS
16.1. Governing law
16.1.1. These Terms and any dispute arising out of or relating to them are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
16.1.2. Where you are a consumer, mandatory consumer protection provisions of the jurisdiction of your habitual residence that cannot be derogated from by agreement remain unaffected.
16.1.3. Subject to Section 15, the state and federal courts located in the State of Delaware have exclusive jurisdiction.
16.2. Entire agreement
These Terms, together with the Privacy Policy and any separate written agreements, constitute the entire agreement between the parties. There are no oral side agreements.
16.3. Assignment
16.3.1. Core Funded may assign its rights and obligations under this contract to a third party, including in connection with a merger, reorganization, or sale of assets, provided this does not materially impair the Customer's interests.
16.3.2. The Customer may assign contractual claims only with our prior written consent.
16.4. Severability
16.4.1. If any provision of these Terms is held wholly or partly invalid or unenforceable, the remaining provisions remain in effect.
16.4.2. The invalid provision shall be replaced by a valid provision approximating its economic purpose as closely as possible.
16.5. No waiver
Failure to enforce a provision on any occasion does not constitute a waiver of that provision or of these Terms.
16.6. Notices
All notices to the Customer are sent by email or via the customer area and are deemed delivered when sent to the most recent contact address the Customer has provided.
16.7. FAQ and precedence
16.7.1. Our FAQ section addresses common questions on matters such as account consolidation, Add-Ons, and payout limits.
16.7.2. In the event of any inconsistency between the FAQ and these Terms, these Terms prevail.
16.8. Effective date
These Terms take effect on the date published on the Website.
